Emery Planning have been successful in obtaining planning permission on appeal for the reinstatement of permitted development rights on an approved replacement dwelling. An application was originally approved for the dwelling without any conditions withdrawing permitted development rights. A revised application was submitted and approved with the council agreeing the changes would be minor. However, conditions were attached removing permitted development rights for extensions and for walls/fences. An application was submitted to remove the conditions controlling permitted development rights. The council agreed to reinstate permitted development rights for walls/fences but not extensions. An appeal was lodged to remove the condition. The Inspector concluded the removal of permitted development rights for extensions was not necessary or reasonable.
