Emery Planning are delighted to have secured planning permission for the removal of an agricultural occupancy condition on a farm workers dwelling at Hurdon Lowe in Grindon in the Peak District National Park.

Outline planning permission was originally granted for a two bedroomed agricultural workers dwelling in 1977.

Emery Planning, with the help of Brown Rural Partnership, successfully argued that as the dwelling was not tied to any agricultural land holding and now only served 1.2 hectares of land that the agricultural occupancy condition has now longer necessary.

It was demonstrated that due to the small amount of unrestricted land associated with the property, that it would not be possible to establish a viable farm business on the land and that together with the properties high value on the open market, even with the agricultural condition attached that the condition was no longer served any functional purposes. The National Park Authority also concluded that a temporary relaxation of the condition would serve no purpose. The condition was removed in its entirety.
