Oakwood – Cheshire East Council

Following a staged approach and multiple planning applications on this site, Emery Planning has secured outline planning permission for the demolition of existing commercial units and the construction of new dwellings including 30% affordable housing at Oakwood Nurseries. The first stage entailed securing retrospective planning permission for the change of use of the site, from a horticultural nursery to a mixed Class B and E use (formerly B8 and B1) to reflect the current site use and establish the site as previously developed land in the Green Belt. The second stage was to vary and remove a number of conditions attached to the aforementioned permission in order to regularise the current position on site. Following this, the third stage was an outline application for residential redevelopment, including indicative drawings showing a policy compliant proposal. The key test at this stage was Paragraph 149 g) of the Framework which permits “limited infilling or the partial or complete redevelopment of previously developed land, whether in redundant or in continuing use (excluding temporary buildings), which would:

  • not cause substantial harm to the openness of the Green Belt, where the development would re-use previously developed land and contribute to meeting an identified affordable housing need within the area of the local planning authority.

Other planning policies such as amenity, design, highways, ecology and so forth had to be complied with.

After much negotiation with Cheshire East Council, the principle of the development was accepted and the application was taken to the Northern Planning Committee with a recommendation for approval. Members voted in favour of the application, subject to completion of a S106 agreement. A great result for our clients in the end!
